Estate Planning Mistakes Can Damage Families- While estate planning includes documents, including a will, a trust and executing them correctly, there’s more to creating an estate plan than paperwork. From unprotected family businesses to confusing inheritances and out-of-date beneficiary forms, failing to have an estate plan created by an estate planning attorney often leads to litigation, lost assets and heartbreaking family divides.

A recent article, “Estate Planning Mistakes That Tear Families Apart–And How to Avoid Them,” from The Star, notes that the worst outcomes arise when people believe they are being fair or that they have plenty of time to figure things out.

Business ownership is among the biggest issues. Families who own businesses are often stunned when they learn that inheriting a business doesn’t automatically mean owning the rights to the business names. People think estate planning starts with a will and a trust. However, in reality, it begins years earlier with business decisions. With a strong succession plan, a business can survive the owner’s death or retirement. However, a brand without protection may not.

Inheriting a company without trademark or copyright protection could mean it is one lawsuit away from losing its brand, spending thousands on rebranding, signage, marketing campaigns and company identity, or losing customers to a new company using its branding.

Trademarks are often registered personally instead of under the business’ name. When this happens, transferring ownership can become an expensive, drawn-out process. If renewal notices or other official documents are sent to a deceased owner, business matters can fall through the cracks.

Estate planning mistakes also come from family dynamics when parents attempt to do what’s “fair” for their offspring. They feel obligated to pass on assets equally among children, even when equal division doesn’t always reflect reality.

This is often what happens in family businesses. Family members who work in the business may feel they should receive a larger share than those who do not. Failing to address this in an estate plan and a succession plan can lead to will challenges, sibling disputes and litigation.

Certain assets can’t be easily divided without being sold. This includes cars, homes and jointly owned property. When instructions aren’t clear, families may be forced to sell assets, even when parents wanted the property to remain in the family.

Insurance policies, retirement accounts and jointly owned property pass entirely outside of the will. If beneficiary designations aren’t updated regularly, these assets will pass to the person named on the form, regardless of the will.

Separated but still married spouses, improperly titled deeds, and misunderstandings about spousal rights can all upend an estate plan after death.
