Estate Planning After Spouse Has Died- The loss of a spouse is considered one of the most stressful events in life. In the months following a spouse’s death, understanding which estate planning and financial matters require immediate attention and which can wait can help a surviving spouse navigate this difficult time of life. A recent article from KRDO, “Financial planning after the loss of a spouse,” explains some of these responsibilities and how to manage them.

The primary focus of a newly widowed person is taking care of themselves and their children, especially if they are minors. The family’s estate planning attorney, financial advisor and CPA should be contacted for help.

Several original death certificates should be obtained, as they will be needed for many different government agencies. In some cases, a copy will suffice. However, having at least ten originals will prevent having to go back to the local Town Hall or funeral home if more are needed.

Some of the steps to take in the early weeks are assessing Social Security survivor benefits, reviewing estate plans and determining what taxes will need to be paid and when. If the decedent was working, their employer needs to be notified, as well as the state’s Department of Motor Vehicles, Veterans Affairs if they were a veteran, and credit bureaus so their accounts can be frozen.

Meet with your estate planning attorney to be sure the decedent’s wishes are carried out, and account ownership, beneficiary designations and estate documents are properly executed. Life insurance claims, trust asset distributions and updating ownership of bank and investment accounts will need to be done.

If the surviving spouse was not the person managing finances, making decisions without their spouse’s input may feel unfamiliar. The surviving spouse is facing a dramatically different world, where they are planning for their own future and creating a budget for themselves.

If possible, it’s best not to make any big decisions in the first year after the death of a spouse. Emotions are raw, and judgment may be clouded. The newly widowed person also needs to be vigilant about scammers, many of whom prey on newly single seniors. People who suddenly take an interest or new best friends should be viewed with caution, as they may be seeking a vulnerable target.

At some point soon, it will be time to meet with the estate planning attorney and be sure the surviving spouse’s wishes are properly documented with a revised will. If the deceased spouse held their power of attorney and healthcare proxy roles, a new person will need to be named.

Your estate planning attorney will be a valuable source of information and legal guidance, as most have a wide network of trusted people who can help during this difficult time.
